HUBER HEIGHTS — A family is seeking legal action after an 89-year-old man and his dog were attacked.

An 89-year-old man and his dog were attacked by a pitbull and a chihuahua in Huber Heights on Saturday night.
Shirley Doran said her father, Charles, is 89 but still very active.
She said Saturday was the second time Charles and his dog Rocco were attacked.

The first time was several weeks ago on Pitcairn Road.
“Pit bull just flew out the door and went after he and his dog, so he quit walking that direction, so that wouldn’t happen again. Fortunately, they weren’t injured seriously,” Shirley said.
But the attack on Saturday, she said, he didn’t see coming.
“He never heard those dogs coming because they got little squeaky barks. Or they have no barks at all,” she said.
The attack resulted in the death of Rocco.
Shirley said owners who have dogs with a history of violence need to keep an eye on their pets.
News Center 7 found a woman with the same name and birthday listed in court documents from a 2015 dog attack in Clark County.
In the documents, the Clark County Dog Warden deemed a pit mix “dangerous” after it attacked and killed a chihuahua.
“They’re being irresponsible. They’re letting them out of the house. They’re letting them roam the streets. In this case, the owner knew the dog was dangerous,” Shirley said.
Kara Hamby from the Montgomery County Animal Resource Center said the best thing to do around a dog is to remain calm and try to walk away.
Try not to engage with the dog, but use a loud, strong voice to order the dog away.
“Contact us. We want to be made aware we are going to run those calls, especially if it’s a dog you know, that is identified as dangerous,” Hamby said.
The Doran family said they are looking to press charges.
