After 10 years in prison, former Springboro Police Lieutenant Jim Barton could be getting out of prison.
Barton has served 10 years of a 15 to 50 year sentence for complicity to the murder of his wife in 1995.
Buoyed by a federal court ruling, Barton’s lawyer is seeking bond securing his freedom while the case is pending. A federal appeals court has ruled he should be released or retried within six months.
The court found prosecutors failed to to turn over everything they could to Barton’s lawyers before his trial. The ruling also described the prosecution’s case as fantastical.
The attorney general is weighing whether to appeal the ruling.
