Dayton man indicted on murder in two shootings that took place hours apart

A man was indicted on murder in the deaths of two people in two different shootings outside a Dayton jazz club and supermarket in December.

Christopher Leon Smith, 28, of Dayton, was indicted on four counts of murder, six counts of felonious assault and four counts of having weapons under disability, according to a Montgomery County grand jury report.

Both shootings took place hours apart on Dec. 5 and within about 100 feet of each other.

The first shooting was around 3 a.m. outside Rick’s Jazz Club on Lakeview Avenue.

Smith is accused of shooting Brandon Harris, 33, and Williams Earnest. The shooting killed Harris and injured Earnest.

About eight hours later, around 10:30 a.m., Smith reportedly shot and killed Clarence Brown, 33, outside the Save Food Super Market on Germantown Street.

Dayton police announced that Smith was captured by the FBI Atlanta’s Violent Crimes Task Force earlier this month in Stockbridge, Georgia.

He is currently in custody in the Fulton County Jail in Atlanta and is awaiting extradition, according to the Montgomery County Prosecutor’s Office. 

Smith is scheduled to be arraigned Feb. 11.
