Texas federal Judge Matthew Kacsmarky issued the ruling Friday on the medication abortion drug, mifepristone.

He said the FDA’s two-decades old approval violated federal rules that allow for accelerated approval for certain drugs and subsequent actions by the agency ran afoul of federal law, CBS News reported.

He is pausing his ruling for seven days so the Department of Justice can appeal to the U.S. Court of Appeals for the 5th Circuit.

We will provide updates on this developing story.
