Dayton officer who shot man in June will not face criminal charges

DAYTON — A Dayton police officer who shot a man on Verona Road in June will not face criminal charges, according to the Montgomery County Prosecutors’ Office.

A grand jury declined to indict Officer Zachary Banks for shooting and injuring Deshawn Trae McGee June 6.

McGee was shot after he exited a vehicle on Verona Road and was armed with a handgun, Dayton Police Chief Richard Biehl said in June.

McGee was shot multiple times but sustained non-life threatening injuries.

Police were first dispatched to the area of a Shell gas station to investigate a report of shots fired. A vehicle, described as “blacked-out” was located. When police approached the vehicle, McGee exited with a gun and was shot, police said.

The incident was the first officer-involved shooting in Dayton in 2018, Biehl said.
