As News Center 7 previously reported, the chain alleges that the cartoon beaver on the mini mart’s sign resembles Buc-ee’s iconic logo too closely.

TRENDING STORIES:

In an amended complaint filed in federal court this week, Buc-ee’s claims the mini mart told news media that “it had never heard any objection for Buc-ee’s prior to its filing the lawsuit.”

Buc-ee’s claims in the court documents that it first reached out to the mini mart, located on Hanes Road, in March 2026 and never got a response.

PREVIOUS COVERAGE:

Buc-ee’s sent the mini mart cease-and-desist letters two more times, including hand-delivering one in June, but did not get a response.

They filed the federal lawsuit the following month.

Eric Estadt, an intellectual property lawyer, told News Center 7 that the new complaint drops state-level unfair competition claims focusing on trademark infringement.

“This really kind of narrows the issues that are going to be before the court. I imagine Buc-ee’s is really doing this strategically to just kind of limit the universe of facts and really try to drive a settlement out of the mini mart here,” Estadt said.

In August, Beaver Mini Mart’s owner provided News Center 7 a statement saying he started using the sign in 2019 and filed a trade name with the state last year after its bank asked him to, but Buc-ee’s had its federal trademark before.

“They had a federal trademark registration,” Estadt said. “It covers all 50 states.”

As reported on News Center 7 at 6:00, the mini mart has not filed responses to anything in this case.

“I think, ultimately, at the end of the day, Beaver’s Mini Mart is gonna be forced to change their name,” Estadt said on Friday.

Beaver’s Mini Mart issued the following statement Friday afternoon:

“We understand and are disappointed that Buc-ee’s amended its complaint rather than dropping it entirely. Beaver’s Mini Mart appreciates the continuing outpouring of support for our small locally-owned business. We are reviewing all of our options with legal counsel and will respond at the appropriate time.”
