A Huber Heights man convicted along with his half-brother in the Dec. 4 robbery of the Abbey Credit Union in Troy was sentenced to four years in prison Tuesday.
Jeremy Miller, 32, was accused of driving the getaway car after his brother Justin Higbee, 36, of Troy robbed the business. Miller originally was charged with felony aggravated robbery. He later pleaded guilty to felony burglary and receiving stolen property in a plea deal with Miami County prosecutors.
Defense lawyer Jeremy Tomb said Miller cooperated immediately with law enforcement. Prosecutors and the defense jointly recommended a four-year sentence.
Judge Jeannine Pratt sentenced Miller in Miami County Common Pleas Court. She reviewed his record, which she said included five previous sentences to prison for charges such as burglary, theft, drug possession and robbery.
Miller made no comment before sentencing. “Your record is horrendous, and the court believes you are a danger to the community,” Pratt told Miller.
Miller was given credit for 166 days served in jail. A separate hearing will be held on the amount of restitution the judge will order. Higbee pleaded guilty to robbery and will be sentenced later this week.
