One of the two brothers arrested after a standoff with SWAT and Dayton police early Sunday morning allegedly fired a handgun several times at a store owner’s car after he was denied service.
The two arrested have been identified as Christopher Farmer, 22, and his brother Craig Farmer, 27, according to the Dayton police report.
Chris Farmer is being held in the Montgomery County Jail on suspicion of discharging a firearm at or into a habitation, obstructing justice, obstructing official business, improper handling of a firearm.
Craig Farmer is being held in the Montgomery County Jail on suspicion of felonious assault, inducing panic, obstructing official business, improper handling of a firearm and disorderly conduct.
Prior to the standoff on Otterbein Avenue, Chris Farmer attempted to buy beer at the Free Pike Drive-Thru, 4053 Free Pike, and was turned away, according to the Dayton police report.
Police said the suspect had been banned from the store because of previous problems, and when he was denied service he started yelling at the employees and the owner.
When the suspect pulled out of the drive-through, he and his passenger allegedly fired multiple gunshots that struck the store owner’s car, according to the report.
When police responded to the 9-1-1 call, the officers were able to review surveillance video and verify the suspect’s identity, which led to police knocking on Farmer’s door on Otterbein Avenue, according to the report.
UPDATE @8:45 a.m.
Police said two men are in custody after a more than four-hour SWAT standoff on Otterbein Avenue.
The incident started with shots fired at the Freepike Drive-Thru at 4053 Free Pike around 12:30 a.m. Sunday. According to dispatch records, shots were fired into the business and a nearby vehicle after service was refused at the store, but people were struck by any bullets.
Dayton police Maj. Brian Johns said at around 2 a.m. the suspect vehicle was spotted at a house in the 2900 block of Otterbein Avenue and officers believed the suspects were inside. Johns said SWAT was requested shortly after when the people inside the house refused to come outside.
Shortly after 4:30 a.m. one of the shooting suspects inside the house and his mother came outside and surrendered to police, but one man remained inside. Johns said that man was also a suspect in the shooting and also had an active warrant for his arrest.
Johns said police were able to obtain a search warrant, entered the house, and arrested the second suspect around 6:30 a.m.
A few neighboring houses were evacuated during the standoff, but Johns said many of the homeowners remained inside due to the cold temperatures.
The two men, who police did not immediately identify, were taken into custody and will face several charges stemming from the incidents.
The mother who was taken into custody, was released and is not expected to face charges.
Police remained on scene after the standoff was over to search the house, but Johns said it wasn’t known if a weapon was recovered in the search.
No injuries were reported.

One person is still believed to be inside a house on Otterbein Avenue in Dayton that is surrounded by police and Dayton SWAT.
Two people, a man and a woman, have come out of the house and surrendered. It’s unclear if the two are under arrest and facing charges or were being held inside the house against their will.

Police continue to surround a house in the 2900 block of Otterbein Avenue as subjects inside refuse to come out.
Armored vehicles are now on scene and police are giving demands for those inside to exit.

New reports indicate neighboring houses are being evacuated.
