Lawmakers May Limit DeWine Health Orders

Even though Ohio continues to set new records for coronavirus cases, some state lawmakers are pushing back on new action by the Gov. Mike DeWine.

The Ohio Health Department Friday reported 8,071 new cases in the last 24 hours.

When Ohio lawmakers return to the Statehouse next week they may be looking at putting limits on DeWine’s legal ability to issue lengthy health orders.

Rep. Jena Powell, R-Arcanum was quick to respond when DeWine this week announced that he is preparing to issue a possible shutdown order for bars, restaurants and gyms if the number of new coronavirus cases does not see a major reduction. Powell said there are already several proposals in the works that could become the vehicle for controls on DeWine’s health orders. “That is what the legislature needs to do and that is my push to get back into session to get together in caucus and get it through so that Ohioans can have their freedom back,” Powell said. She has been one of the most outspoken critics of the governor’s handling of the virus.

DeWine has not identified a  certain number of new cases that would trigger the next round of shutdowns. Instead, he said Thursday it will be a combination of factors that will go into his decision, including input from experts from hospitals around the state. “I didn’t run for Governor to shut down stuff. That’s not what we want to do. But we are going to be careful and what I’m asking is put your mask on and be careful,” DeWine said. DeWine noted that Ohio is not the only state facing an increased number of cases. The state of New York, for example, ordered all bars, restaurants and gyms to close at 10pm, touching off a wave of criticism.

Even some lawmakers who generally get along with DeWine are pushing for more shutdowns to be avoided. Rep. Niraj Antani, R- Miamisburg, who recently was elected to the State Senate, said the state’s economy is at risk.  “Shutting things down just doesn’t make sense. We just really need to reinstitute social distancing, washing of hands, wearing of masks and at the same time we have to let our economy continue to open,” Antani said.

DeWine is expected to reach a decision on additional action next week.
