Dayton man sentenced to life in prison after convicted of rape of a special needs child

DAYTON — Michael Luther, 34 of Dayton was sentenced on Monday to life in prison without the possibility of parole after he was convicted of raping a 6 year old special needs child and photographing the assaults.

Luther was indicted in March for four counts of rape of a child under the age of 10 and 18 counts of pandering obscenity involving a minor.

On February 15, 2020, a citizen found a memory card in a parking lot in Dayton and discovered it contained child pornography. He immediately notified the Kettering Police Department and the evidence was then passed over the evidence to Dayton Police.

Further investigation identified Luther and the victim, who has Cerebral Palsy, is nonverbal and confined to a wheelchair. Luther had been entrusted to care for the child while their mother was at work.

Luther was found guilty on August 12th and sentenced Monday to 26 years to life in prison. He was also designated a Tier III sex offender.

“Thanks to the efforts of the citizen who found and turned over the memory card to the police, this defendant has been held responsible for his heinous conduct,” said Prosecutor Mat Heck. “Anyone who would sexually assault a six-year old child with Cerebral Palsy certainly deserves a lengthy prison sentence.”
