Man with paint ball gun brings out Miamisburg police

Police responding to a call about a man with a gun discovered the weapon was a paint ball gun.

"We treat it like it's the real thing... because that was the information we had," Miamisburg Sgt. Josiah Keefer said.

After about an hour -- officers had to go inside a Pearl Street residence because that's where the man had fled -- police took him into custody but did not arrest him.

They took the gun as evidence, Keefer said, and will present it and the rest of the evidence (witness statements) to the Montgomery County Prosecutor's Office for possible charges.

Police were dispatched to the area after neighbors and people in the area called the Miami Valley Regional Dispatch center sometime after 7 p.m. to report that a man pulled a gun on them.

Keefer said police don't believe the man was intoxicated, but noted, "it is illegal to put somebody in fear of bodily harm."

If anything, the sergeant said, the man would be charged with menacing.
