MONTGOMERY COUNTY — A man has learned his punishment for shooting and killing a 33-year-old in front of an Arby’s restaurant in Dayton.

David Brown was sentenced to 35 years to 40.5 years to life in prison.
Brown was found guilty of murder, felonious assault, aggravated robbery, and having weapons under disability.

As previously reported by News Center 7, Morrell Fontenot, 33, was shot and killed in the 2800 block of Salem Avenue in July 2024.
Dayton police gathered enough evidence to charge Brown in December 2024.
Police said that Brown robbed Fontenot, even going through his pocket after he was shot.
“Justice had been served, I’m happy, I am happy, I’m much relieved,” Fontenot’s mother, Stephanie Fontenot, said.
Stephanie said seeing Brown sentenced to decades behind bars is some relief for her son’s death.
“He didn’t know my son. He made remarks about what he did to my son. I’m glad he got what he got. He deserves it,” she said.
Stephanie said she and her family had to deal with Brown denying his involvement, never admitting guilt, even before the judge sentenced him.
“I thank my family for showing up to support me here today, and I just leave it to the professional liars at this point,” Brown said in court.
Stephanie said her family believes the turth catches up to everyone.
“I just know that he can’t hurt nobody else. He’s where he needs to be; he wants to act like an animal, so now he’s about to be treated,” she said.
