Miamisburg deadly shooting suspect set for court Monday

MIAMISBURG — Prosecutors have approved charges for a man accused of shooting and killing another man in Miamisburg last week.

Leads in the case led detectives to Tony Smith, 27, as a suspect. Smith is scheduled to appear in Miamisburg Municipal Court Monday morning, online records show.

Smith was arrested Thursday.

On Friday, Smith was charged with 14 charges including two counts of murder, aggravated robbery, aggravated burglary, felonious assault and tampering with evidence were approved, prosecutors said.

Smith remains in Montgomery County Jail.

Police said crews responded to a residence in the 1100 block of Pearl Street in regards to an unresponsive male on Wednesday, just after 12:30 p.m.

In a 911 call obtained by News Center 7 through a public records request, a caller told dispatchers that she came home from work and found her boyfriend face-down on the floor, bleeding.

“He’s got a gash on his head, he’s bleeding,” the woman said.

Upon arrival, police found a man with an apparent gunshot wound to the head.

A dispatch log identified the victim as 28-year-old Dylan Judd. Judd’s body was taken to the Montgomery County Coroner’s Office, however autopsy results were not immediately available, a coroner’s office spokesperson said.

Judd was pronounced dead on the scene.

Police said circumstances at the victim’s residence indicated his injuries were not self-inflicted and a homicide investigation was started.
