Family ready to see justice as case of mom, boyfriend accused in death of 7-year-old hits new delays

DAYTON — The court case involving the death of 7-year-old Hershall Creachbaum has been delayed, but his family is ready to see the case move toward a possible trial.

Creachbaum’s mother, Ashley Johnson, and her boyfriend, Michael Kendrick, appeared in court today in Dayton.

There, a defense attorney told the judge he’s waiting for prosecutors to turn over piles of potential evidence to review and isn’t ready to move forward. Johnson’s lawyer said the same thing.

As reported on News Center 7 at 5:00, prosecutors also requested a delay as they’re waiting for a report from a forensic anthropologist, who is studying the boy’s remains.

Creachbaum’s aunt, Jessica McNier, was in court on Thursday and told News Center 7 she plans to keep the heat on everyone involved in the case.

“For Hershall, yes, I am — I’m ready to see them prosecuted,” McNier said. “I am ready to see them. They should get the death penalty, (that) is what they should get.”

As previously reported, Dayton Police began their investigation when they received calls reporting Creachbaum was missing in July. They discovered the 7-year-old’s skeletal remains later that same day.

“How can they sleep at night? I don’t see how him or Ashley can sleep at night knowing what is going on and what they did to my nephew,” McNier said.

As previously reported, Kendrick faces gross abuse of a corpse and tampering with evidence charges, while Johnson faces obstructing justice charges.

Currently, no one is facing charges directly related to Creachbaum’s death.
