LIVE UPDATES: Prosecution to call more witnesses on Day 4 of Caleb Flynn Murder Trial

Mrs. Bingaman says her home security cameras did not capture anything unusual on February 15 nor on the 16th.

Bingaman is off the stand and excused from further testimony.

The next witness the state calls is Kimberly Bingaman from Tipp City. She lives on Cunningham Court. She was one of Caleb and Ashley’s next-door neighbors.

The next witness the state calls is Vicki Bartholomew, Ohio BCI, Forensic Scientist in the Latent Print section of the lab. She deals with fingerprint and handprint evidence.

UPDATE @ 3:19 p.m.:

They found the one bullet in Ashley’s elbow. The other was found in her pillow. We heard about those locations yesterday from BCI and the Montgomery County Coroner’s Office investigator but Miller is being asked where those bullets came from, and she repeats those locations.

Miller testifies that both bullets found in the Flynn home were fired by the same firearm.

The next witness the state calls is Alex Miller, Ohio BCI. She works in the forensic firearms section of the lab at BCI’s Bowling Green office.

He said he searched the area around the house and the wood line and the farm field near the home over two days with his K9 partner and did not find anything. No cross-examination from the defense. He’s off the stand and excused from the witness list.

He says his K9 partner specializes in finding firearms and firearms-related evidence.

This is the exchange between Defense Attorney Emily Smith and Capt. Tony Smith with the Tipp City Police Department.

Capt. Smith testified that, at one point in the murder investigation, he collected “miscellaneous items” from Alleigha Botner’s office at Christian Life Center (CLC), the Flynn’s church. Ms. Botner has been identified in open court as Caleb Flynn’s mistress.

Capt. Smith: “There were some documents, a picture frame, a laptop computer. I apologize if I can’t remember exactly what else it was.”

Emily Smith: “Through the course of your investigation, were you made aware of any missing devices?”

Capt. Smith: “Yes.”

Emily Smith: “What missing devices were you making aware of?”

Capt. Smith: “I learned during the investigation that prior to our investigation Ms. Botner had taken a vacation to Florida, I believe it was, and during that time somehow lost her work computer. It was left on a plane, I don’t remember the exact circumstance, somehow her laptop was missing. And she had also dropped her cell phone in water on that trip.”

Capt. Smith testified that that trip to Florida was in January 2026. The month before Ashley’s murder.

They are going to break for lunch now. They will restart the trial at 12:45.

Defense finishes questioning Capt. Smith. He’s off the stand.

UPDATE @ 11:33 a.m.:

Miami County Prosecuting Attorney Paul Watkins is questioning Capt. Smith. Capt. Smith is testifying that he subpoenaed, and later received, bank records and credit card records for Caleb and Ashley Flynn.

Capt. Smith testifies that there was a life insurance policy for Ashley Flynn – in the amount of $100,000 – and that Caleb Flynn was sole beneficiary on that policy.

UPDATE @ 11:13 a.m.:

Todd Smith, Ashley’s father, says after Ashley’s murder, the story about the break-in didn’t make sense. He said among the things that didn’t make sense was why the family’s two dogs would not have barked at an intruder. Mr. Smith testified that the dogs would start barking if people were even in the cul-de-sac. He then said, “I even Googled, ‘Could a Christian man snap and kill his wife?’”

Todd Smith is off the stand. No questions from the prosecution. He’s been excused from the list.

The state calls Todd Smith, Ashley Flynn’s father, to testify. He’s on the stand now.

We’re back in session at 10:52 from the morning break.

The state has finished questioning Mr. Keyt. Defense has no questions for him. He’s released from the witness list, which means he also can be in the court for the rest of the trial. They are taking their morning break now. Judge Pratt says they’ll resume at 10:45 a.m.

UPDATE 10:17 a.m.:

Defense has finished questioning Kayla. She has been excused from the witness list. This means she can now sit in the court for the remainder of the trial.

UPDATE 9:55 a.m.:

The state has finished questioning Kayla. Pat Mulligan from the defense is now questioning Ashley’s sister.

UPDATE @ 9:33 a.m.:

The defense does not cross-examine Mrs. Smith. She’s been excused by the court from the witness list.

This means Mrs. Smith is now able to be in the courtroom for the rest of the trial now that she’s testified. She is now seated in the gallery.

Ofc. Roberts is off the stand and Ashley’s mom, Jill Smith, is testifying.

Bailey Arnett, Miami Co. Asst. Prosecutor, is questioning Mrs. Smith.

Judge Pratt gave a stern warning to people in the gallery about courtroom behavior.

Judge Jeannine Pratt, Miami County Common Pleas Court, said:

“Again, I will remind those that are in the gallery, whether it be the public, spectators, or members of the family, there will be no disruptions in this courtroom. If I see any, or if the deputies see any you’ll be removed from the courtroom. Possibility of a penalty, or be held in contempt. I will not tolerate it. This is a court of law. We have an order of decorum that’s been filed with this court, and I expect that.”

She did that right before the jury came in.

The first witness of the day is Officer Will Roberts of the Tipp City Police Department.

Miami County Asst. Prosecutor Matthew Joseph is questioning him.

Testimony to continue on Day four of Caleb Flynn’s murder trial. The prosecution is expected to call more witnesses on Tuesday.

He’s accused of shooting and killing his wife, Ashley, in their Tipp City home in February as their daughters slept.

On Monday, Ohio Bureau of Criminal Investigation Special Agent David Hammond testified for over three hours.

He told the jury that he collected evidence from the Flynn’s home for 12 hours.

At the end of his examination, the prosecutors asked him, based on the evidence, about his conclusion.

“My concern at the end of the scene examination was that this was a homicide and it was staged as a burglary,” said Hammond.

Before collecting evidence, he documented that evidence with pictures throughout the house.

That included pictures of how investigators said they found Ashley Flynn’s body in her bed.

Caleb Flynn started crying, wiping his nose, and wincing as prosecutors showed the photos.
