Police: No charges in accidental shooting at Austin Landing HomeGoods store

The 61-year-old man who accidentally shot himself in the lower abdomen in the bathroom of the TJ Maxx/Home Goods store at Austin Landing on May 28 will not face any criminal charges, Miami Twp. police said Monday.

The Xenia resident told officers he was carrying a new gun and it did not fit in the holster properly, but he was trying to make it work, according to a police report.

Officers seized the gun. A bullet casing was found near the toilet where the incident happened.

The man was in a restroom stall when he was transferring the gun from the rear of his body to the front. The gun discharged while he was doing that.

The man told police it was an accident and he was embarrassed.
