DAYTON — Police fought with a man while arresting him, moments after they got reports he was inappropriately touching himself at a Dayton restaurant.
Nicholas Holmes, 40, was arrested Saturday after customers and employees tried to help a couple of girls he’s accused of following at the China Buffet in the 800 block of East Fifth Street.

Holmes has a history of arrests, including a couple of times where he was accused of similar activity to what was reported Saturday.
A customer called 911 to say the man had asked some teenagers for change before following them into the restaurant.
Employees at the buffet said they told Holmes to leave after they said he touched himself and performed a sex act on himself. The employees also said he was harassing customers.
Police found Holmes in the parking lot, where he was arrested and taken to Montgomery County Jail. He’s charged with public indecency, obstructing official business and resisting arrest. He’s pleaded not guilty to the charge.
It’s not the first time Holmes has been accused of similar crimes. In February, Holmes was found guilty of public indecency.
In 2017, he was accused of sexual imposition, but was found guilty of menacing, court records show.
In 2018, he was convicted for assaulting an officer and got five years probation in that case.
A trial for Holmes' latest case is set for Oct. 13, records show.
