A Richmond, Ind. contractor was indicted by a federal grand jury Tuesday for obstruction of justice and violating the Toxic Substance Control Act concerning lead paint.
Jeffrey Delucio, co-operator of Aluminum Brothers Home Improvements LLC in Richmond, failed to follow lead-safe work practices while renovating homes in the Richmond area, according to a release from the Department of Justice.
While renovating residences, lead-based paint chips were left on the floors and were not cleaned up timely or adequately, according to the Department of Justice. One of the homes being renovated was home to a child with elevated blood lead levels, which prompted the work in the first place.

Prosecutors allege Delucio failed to train his workers on lead-safe work procedures and then proceeded to conceal that he had not trained his employees but, in response to the subpoena, fabricated records to state that he did.
“Mr. Delucio failed the community, his employees, and the environment. This is another example of bringing those who violate that responsibility to justice to help protect our citizens and preserve the environment for current and future generations,” said acting U.S. Attorney John Childress in the release.
Delucio has been charged with two counts of violating the Toxic Substances Control Act and one count of falsifying documents. If Delucio is found guilty, he faces up to 20 years in prison.
