Officer says suspect spit in his face

Two men were arrested on multiple drug and resisting arrest infractions Sunday evening after police say one of them attempted to run from a traffic stop and the other spit in an officer's face.

Matthew Fugate, 27, was booked into the Montgomery County Jail pending charges of obstructing official business, resisting arrest, possession of drugs, drug abuse instruments, drug parapharnelia and a warrant out of Greene County.

Rodney Buchanan, 51, is facing possible charges of throwing bodily fluids at law enforcement officer, obstructing official business, resisting arrest, possession of drug abuse instruments and drug parapharnelia.

According to a Dayton police incident report, the pickup in which the men were passengers was pulled over for traffic violations on South Jersey Street just before 5 p.m. Sunday.

Fugate immediately got out of the vehicle and tried to run, according to the report, but was stopped when an officer deployed his Taser and arrested him. He was found with needles and suspected heroin in his pocket according to the report.

Buchanan reportedly tried to get out of the vehicle initially as well, but was forced to sit down. Then when he was asked to get out he refused, according to the report. He was eventually handcuffed but later spit in the face of an officer.

Police found open containers of alcohol in the vehicle and more drug parapharnelia in a bag where Buchanan had been sitting.

The driver of the vehicle was not arrested. He was issued several traffic violations and allowed to leave.
