A mistrial was declared Monday afternoon in the murder trial of Brandon Moxley.
Moxley hugged his attorney, Andrea Oladi, as Montgomery County Common Pleas Judge Steven Dankof excused the jurors after the foreman said additional time would not result in a unanimous decision. The jury deliberated for more than six hours on Friday and from Monday morning until about 3 p.m. Monday before sending a note to the judge saying they could not agree.
Prosecutors said Moxley, 25, ambushed and shot to death 29-year-old Rodney Frost outside Frost's Valerie Arms Dr. apartment on June 19, 2013. Defense attorneys said Moxley did not know Frost.
Dankof said the case would go back on the docket with an Oct. 8 scheduling conference.
