Man indicted for murder in death of sister, 3

UPDATE @2:50 p.m. Feb. 24: Brian Scales Jr. was indicted today on charges of child endangering, aggravated murder of a victim under the age of 13 and two counts of murder.

UPDATE @ 5:42 p.m. (Feb. 18): A 21-year-old man has been charged with aggravated murder and two counts of murder in the death of his 3-year-old sister.

Brian Scales Jr. is accused of killing Tristan Carlton of Trotwood. He is to be arraigned this week in the Western Division of Montgomery County Municipal Court in New Lebanon.

UPDATE @ 6:30 p.m. (Feb. 17): A charge of felony child endangering has been approved against the 21-year-old brother in the death of 3-year-old toddler, which is being investigated as a possible homicide.

Brian Scales was taken into custody by police Saturday on a warrant unrelated to the investigation into the death of Tristan Carlton, Trotwood police Capt. John Porter said in a statement released Tuesday afternoon.

The child endangering charge was approved by the Montgomery County Prosecutor’s Office late Monday afternoon, Porter said.

The warrant in the unrelated case involving Scales is through the Western Division, Montgomery County Municipal Courts. He remained in the county jail on Tuesday night.

Porter, about the death investigation, said, “it is expected that additional charges concerning this incident will be filed within the next few days.”

UPDATE @ 9:55 p.m. (Feb. 16): The toddler is identified as Tristan Carlton, according to the Montgomery County Coroner's Office.

FIRST REPORT

Trotwood police are investigating the suspicious death of a 3-year-old girl, officials said in a statement Monday.

Crews responded to a 911 call Saturday from the toddler’s mother at the 800 block of Broad Oak Drive.

The mother told investigators she found her daughter unresponsive after returning home from shopping.

Medics attempted to revive the toddler but were unsuccessful. An autopsy was conducted Sunday and the results are pending.

The child’s 21-year-old brother was taken into custody on an unrelated warrant from Montgomery County.
