Man, whose girlfriend died after assault, gets prison

A Dayton man who admitted to felonious assault involving his girlfriend, who was found dead a day after police were called to her home on a report of domestic violence, is going to prison for six months.

Eric Cason, 34, was sentenced this week by Montgomery County Common Pleas Judge Gregory Singer. Charges of domestic violence, resisting arrest and intimidation of a crime victim or witness were dismissed as part of a plea agreement for Cason, whose trial was to start next week.

The sentence is to be served concurrently with any sentence imposed in an unrelated Warren County criminal case. Cason was credited with serving 91 days in jail in the case that involved his late girlfriend, Jamie Volk.

Volk, 28, was found dead March 5 in her home on Pritz Avenue a day after she reportedly was assaulted by Cason. Police were called to the same address the day before, after Volk’s 11-year-old son dialed 911 from a neighbor’s home. Police responded and pursued Cason, who ran. Officers apprehended and Tased him.

Volk had told officers Cason threw her into a TV, then onto a bed and choked her for a couple of seconds, according to a police report.

In May, Cason’s attorney asked the court to exclude Volk’s comments to police. “These statements are hearsay as Ms. Volk is now deceased and cannot testify,” the attorney wrote in the court filing.
