The high school student who found and distributed a nude image of a Union, South Carolina, teacher has been charged with a computer crime and voyeurism.

The 16-year old was charged Friday with violating the state’s computer crime act in the second degree and a count of aggravated voyeurism.

The student, who is not being named because of his age, is being held at a juvenile detention facility for a hearing at family court.

Teacher Leigh Anne Arthur worked 13 years at the Union County Career and Technical Center. She quit this week after the picture was sent to other students in a text and shared on social media.

Arthur, 33, was on hall patrol duty on Feb. 18 when she left her phone on her desk, unlocked. The student grabbed the phone and found a nude photo she sent to her husband for Valentine’s Day.

She said she was forced to resign. However, Superintendent David Eubanks said it was her choice, according to The New York Times.

A petition asking for her return to the classroom has been signed by more than 13,000 people.

She already has forgiven the boy.

“He’s 16,” Arthur told WYFF earlier in the week. “He’s going to make stupid decisions. We all make stupid decisions when we’re 16.”

Both charges are misdemeanors for a first offense. If convicted of both the student could be sentenced to pay a maximum fine of $10,500 and up to four years in prison.
