UPDATE: Man wanted after hours-long standoff at Dayton house located, arrested

DAYTON — UPDATE @ 2:25 p.m.:

A man wanted for firing shots and sparking a standoff that spanned seven hours in Dayton was arrested by police later Wednesday morning, according to investigators and a police incident report.

Damon B. Smith, 46, was located by police in the 1100 block of West Third Street around 10:30 a.m. and taken into custody. Smith is facing a preliminary charge of felonious assault and has been booked into the Montgomery County Jail, according to online jail records.

A second person, identified as a relative of Smith, was with him when he was located and was also arrested, but the charges are not related to the overnight standoff, police said.

Investigators said Smith fired shots at his neighbor around 9 p.m. Tuesday on Demphle Avenue and officers believed he ran into his house.

After requesting SWAT and a hostage negotiation team, police found Smith was not in the house after the seven-hour standoff, Dayton police Lt. Jason Hall said in a statement. Officers began looking for him and later located him about six hours after the standoff ended.

The shooting appears to stem from an on-going dispute between Smith and his neighbors, Hall said.

No injuries were reported in the incident. Additional details were not released.

FIRST REPORT

An hours-long standoff at a Dayton home ended without an arrest early Wednesday morning and police are continuing to search for the suspect.

The incident began as a report of shots fired at a home on Demphle Avenue around 9:30 p.m. Tuesday, according to investigators.

Police and SWAT units surrounded the house for hours and demanded a person surrender. However when police got inside the house Wednesday morning, after a nearly seven-hour standoff, they found no one was inside.

Dayton police Major Christopher Malson said investigators are working to find out when the man was able to leave the house. Malson added a delay in the police response time might have given the man time to leave before officers arrived.

Police did not release the name of the man they are looking for, however officers said there is no threat to the public.

A neighbor told News Center 7′s Kayla Courvell the man fired a gun at him, which prompted him to call 911.

The neighbor added once police arrived at the scene the man then fired more shots, went inside of his home, and refused to come out.

The standoff prompted Dayton police to take to social media late Tuesday night, urging the public to avoid the area of the standoff for their safety.
