2 theft suspects arrested after one of them fires at witness, police during pursuit

UPDATE @ 8:53 p.m.: 

An 18-year-old has been booked into jail and a 17-year-old girl remains in custody on charges accusing them of trying to avoid arrest after stealing merchandise from the Walmart in Moraine on Monday morning:

• Sherron Davis, 18, remains in jail on a preliminary charge of felonious assault
• A girl, 17, with him was arrested on theft and property charges
• A boy, 10, with them has been released to a guardian
• A bystander who followed the suspect vehicle from the store was fired upon

EARLIER REPORT: 

According to police, Sherron Davis fired shots at a witness who followed a car carrying him, the 17-year-old girl, a 10-year-old boy and a dog from the Walmart and at police during a subsequent pursuit in Moraine, police investigators said.

A bystander witnessed a theft from the Moraine Walmart about 10 a.m. and followed the suspect vehicle from the store, Moraine police said in a statement released Monday afternoon.

“The witness followed the suspects on Elbee Road, near the intersection of Southtown Boulevard, in an attempt to get a license plate number,” investigators said in the statement. “There, the suspects fired shots in the direction of the witness.”

An officer in the area saw the vehicle, a 2011 Chevy Impala reported stolen, near West Dorothy Lane and Springboro Pike. Police said at least one shot was fired toward the pursuing officer.

Police continued the pursuit to the area of Arbor and Carillon boulevards, where it ended with three people taken into custody.

No one was injured in the gunfire, police said.

Davis was booked into the Montgomery County Jail just after 5 p.m. on a preliminary charge of felonious assault. The girl was arrested on charges of theft and receiving stolen property. Her name has not been released because she is a juvenile.

The 10-year-old boy was released to a guardian, police said.

The dog was removed by Montgomery County Animal Resource Center officers.

According to police, a Moraine officer reported at least one shot was fired out of the vehicle toward pursuing officers.
