The indictment accused Rutherford of sexually abusing the two children, both under the age of 12, during a period of time from January 2020 to May 2020 on the base.

Details about how Rutherford knew the children and specific details about the crimes are under seal in federal court, which means they cannot be released to the public.

The FBI and Air Force Office of Special Investigations are leading the investigation on the case.

Rutherford is currently being held in the Montgomery County Jail while he awaits a scheduled trial date in July.

According to the indictment, Rutherford “did knowingly engage in a sexual act” with both of the children.

Federal prosecutors said if he is convicted for the crimes he could face 30 years in prison.
