Dayton man grabbed officer’s weapon during arrest, police say

DAYTON — A man here grabbed an officer’s gun, reportedly with both hands, while getting arrested. Dayton officers had to tase the man.

It’s the second time in two days someone was arrested following a struggle with or threat made against local police.

In Dayton on Tuesday, officers responded to a domestic violence call. One of the subjects involved — 23-year old Tony Smith — had a warrant, and that’s when officers say the scene escalated.

After he was placed in handcuffs, Smith allegedly "grabbed onto (the officer’s) service weapon with both hands.”

The officer’s narrative on the police report said he felt the suspect “pull up on my weapon in attempts to to free it from its holster.”

Smith’s bond was set at $50,000 for his charges of resisting arrest and aggravated robbery.

Just 24 hours earlier, a Huber Heights officer faced similar danger — a physical confrontation with a man with an active arrest warrant.

Sgt. Charles Taylor, Huber Heights police, said the suspect in their case, John Lee Burke, reportedly said he was going to get his weapon and shot and kill officers.

“We take every situation serious. When a person threats bodily harm or death to us, obviously it's escalated even more so, we cannot let our guard down for even one second,” Taylor said.
