Investigation arises from Dayton shots fired call

UPDATE @ 11 a.m. Jan 28:

The Dayton Police report, obtained by WHIO, tells a different story.

The officer reported as he tried to stop two of them from fleeing, he “pulled my service weapon into my chest in a canted position. While tussling with and attempting to prevent (two suspects) from leaving , I accidentally fired one round directly into the ground. After discharging the round, I was able to holster my weapon and separate the two suspects.”

The four men arrested have been identified as:

Fred Benson, III, age 21 (driver)

Robert E Montgomery, Jr, age 26

Deantre C Reece, age 22

Brandon Omega Thompson, age 26

The fifth subject remains at-large.

UPDATE @ 11:33 p.m., Jan 27: A police department administrative investigation is underway stemming from the Dayton shots fired call in the 200 block of Yale Avenue.

A Dayton police officer, who has not been identified by name, accidentally discharged his service weapon as he was returning it to his holster during a drug investigation that brought officers to Yale Avenue about 4:20 p.m., Asst. Chief Robert Chabali said.

The discharge occurred after the officer made contact with five males who were in a van parked on Yale where suspected drug sales were occurring, Chabali said. A report about suspected drug sales brought police to the area.

When the shot was fired, away from the five males, they scattered. That prompted the officer to call for a signal “99” — officer needs assistance — to help corral the runners. Four of them were apprehended and they were being questioned Tuesday night, Chabali said.

As of Tuesday night, the fifth continued to elude apprehension. All five of the males are ages 21 to 26.

Chabali said police found a semiautomatic pistol and suspected heroin in the van and seized those items. Police had been paying attention to the area because of several recent shootings and reports of shootings in the area, the assistant chief said.

There was no word on when the police department’s administrative investigation would issue findings stemming from what Chabali said was “an unintentional discharge.”

UPDATE @ 6:03 p.m.: Four of five young men, who scattered from a van in the 200 block of Yale Avenue when police arrived to check a report of suspected drug activity, have been apprehended.

Police are continuing to search for the fifth.

When officers arrived to check out the drug report, their attention was drawn to the van, which was parked on the street, police tell News Center 7’s Layron Livingston.

FIRST REPORT

Police have been deployed at several intersections in the 200 block of Yale Avenue after shots were fired and a signal “99” — officer needs assistance — was issued this afternoon.

Police are focusing their attention on an apartment complex in that area, and have officers set up in the area of Byrn Mawr Drive and Yale, Cambridge Avenue and Yale, North Broadway and Yale.

A K-9 has been called in to track a suspect and an evidence crew has been dispatched.
