Miami County school district sued over child restraint incident

TROY — A Bradford family is suing Bradford Exempted Village Schools and a teacher stemming from a 2015 incident involving a child who was a reportedly restrained in a chair with tape and had tape placed over his mouth.

The lawsuit was filed in Miami County Common Pleas Court.

The Miami County Sheriff’s Office investigated the Oct. 21, 2015, incident, which occurred in a classroom. The prosecutor for Municipal Court declined to file charges.

District Superintendent Ken Miller was not available Wednesday afternoon for comment.

In the lawsuit, the parents claim the child was forcibly restrained in front of his peers. They accuse the teacher of assault and battery, claiming the child suffered physical and emotional injuries.

The parents also claim a loss of their son’s companionship.

They are seeking a judgment of in excess of $25,000, along with $500,000 in punitive damages.
