Trial set for Ex-Time Warner tech accused of sex crime

A trial date for James KD Brown, the former Time Warner Cable tech accused of gross sexual imposition, has been set.

Brown’s trial is currently scheduled to take place beginning Jan. 9.

A day after being indicted by a grand jury, James KD Brown is in Montgomery County Jail, accused of gross sexual imposition against an elderly woman. He will be arraigned Sept. 13.

An arrest warrant has been issued for a man who was working as a Time Warner Cable technician when he was accused of committing a sex crime against an 84-year-old female resident at a care center in Miami Twp.

The care center, Laurelwood, which is an assisted living and memory care community, has changed its protocols since the accusation against James KD Brown, 25, which turned into a formal charge Monday when a Montgomery County grand jury returned an indictment on one felony count of gross sexual imposition of a substantially impaired victim.

Brown is accused of an April sex offense against the woman at the facility on Summit Glen Drive, according to the Montgomery County Prosecutor’s Office.

Brown had been on campus for several days, Laurelwood spokesman Brian Fawkes said.

An aide performing a patient check reported finding Brown in bed with the woman , according to prosecutor’s spokesman Greg Flannagan.

The incident occurred during a period when all cable customers had to be converted to new cable boxes.

“Our top priority for our residents is to keep them safe, secure and comfortable,” Fawkes said.

The nursing center has since changed its protocol for third-party and outside vendors, he said. Prior to the incident, outside vendors only had to sign-in upon arrival.

Protocol now includes signing in, being given a badge and an escort to the destination, being accompanied by a staff member while the work is being performed, then being escorted out of the building, Fawkes said.

Brown was suspended by Time Warner at the time of the incident and is no longer an employee, said Mike Pedelty, spokesman for Charter Communications, which now operates TWC properties.

The spokesman, in a prepared statement released via email, said, “We take these allegations very seriously and have been working with police during their investigation.”

Miami Twp. police Capt. John Magill said, “If you have a loved one or family member that’s in a nursing home or any kind of care facility … it’s important that the extended family or care network of that person take into account that it’s very easy and very common for that individual to become a victim of a crime.

“It’s important (family) protect that person’s physical well-being, financial well-being and emotional well-being. All three of those things are levers that criminals will use to take advantage of people that are in need or confined to a care facility,” the captain said.

Brown is to be arraigned in Montgomery County Common Pleas Court on Sept. 13, according to the prosecutor’s office.
