2 indicted in fatal fentanyl OD death in Miami County

Two men face manslaughter and drug charges in the February overdose death of a Concord Twp. man.

A Miami County grand jury today indicted Derek T. Gardner, 32, formerly of West Milton and most recently of Sidney, and Quincy Mattison, 28, of Dayton. They are charged with involuntary manslaughter and aggravated trafficking in drugs. The men are accused of causing the death of 33-year-old James Lennon as a result of the sale of fentanyl.

Bail of $55,000 was set last week for Gardner, and the same amount was set today for Mattison in county Common Pleas Court.

Sheriff Dave Duchak said today deputies and medics responded to Lennon's residence, finding him not breathing. A female at the residence also overdosed, but survived. 

"These cases are not easy to bring to resolution," Duchak said.
