We’ll learn more today about the fate of the Maryland-ACC lawsuit as the suits will take it before the NC Court of Appeals Thursday. Maryland of course is trying to escape paying the $52 million exit fee while the ACC seeks to enforce it. There are various arguments for and against, and we realize the ACC may not prevail. However, to argue, as Maryland appears to be doing in part, that the university should not have to pay because it’s more than the budget allows, is novel and would set an interesting precedent.
Win or lose, the ACC seems determined to make the exit as expensive as possible for Maryland.
