The dog was tied to the tracks by a man who said his family didn’t want it anymore and they had no idea what to do with it.
An engineer in the train yard saw the man walking away after he left something on the tracks near Riverside, California.
Thinking it was odd and then seeing something on the tracks, the engineer hit the brakes and stopped just short of the 10 month old poodle-terrier mix.
The man who left the dog was arrested by a Union Pacific agent then later on released to his family.
Police say they won’t charge the man with animal cruelty "because the man appeared to be confused or senile and didn't fully understand what he had done."
The puppy has been nicknamed Banjo and is now up for adoption.
